A Sandy Hook copy cat threat in California ? Simply a immature youth with an extremely horrid sense of humor and tone deaf sense of how the timing of his comments would be received ? Does he lack the required motivation to be considered a credible threat - can you take him at his word he was " just joking " ? However you slice it , his lack of concern and compassion is blood chilling - regarding the actual pain and suffering of others , does this kid need mental help ? In light of Sandy Hook and the timing of his published statements ( coupled with his access to guns and ammo in his parents apartment ) - shouldn't the guns at a minimum be taken away until this potential threat is cleared beyond a shadow of doubt ?

The 24-year-old man who threatened to commit Sandy Hook type crimes in L.A. claimed he was hell-bent on leaving "dead kindergartners" in his wake ... yet he will not be prosecuted.

Kyle Bangayan posted threats on Facebook the same day as the Newtown shooting ... and claimed he was targeting L.A. schools ... this according to a search warrant obtained by TMZ.



Kyle allegedly wrote, "No really America, if you post one more Facebook post about the shooting at that elementary school, I swear to whatever f**king god you believe in that I will do the same goddamn thing."

The rant continues, "I have the guns, I have the incentive, and I won't commit suicide at the end, I'll just go to the next f**king school and the next and the next ..."

And he goes on ... "So I woke up this morning and said to myself ... Dang you know [what] would be really awesome right now ... some dead kindergarteners ... and Christmas early."

Kyle was arrested in L.A. after a tipster told the LAPD about the online threats -- and when cops searched his bedroom (at his parents house) they found six semi-auto handguns, two rifles and one shotgun.

Now for the kicker.  Kyle was released and the L.A. County D.A. said no charges would be filed, because the threats were not specific.

HOLLYWOOD (CBSLA.com) — A 24-year-old Pomona man’s alleged violent Facebook threats against Los Angeles elementary school students in December have been made public.
The online postings by Kyle Bangayan, which were made on the same day as the Newtown, Conn., massacre, were revealed in a Los Angeles Police Department search warrant.
“I have the guns, I have the incentive, and I won’t commit suicide at the end, I’ll just go to the next school and the next,” he reportedly wrote on the social networking site.
Bangayan continued, “So I woke up this morning and said to myself…dang, you know what would be really awesome right now…some dead kindergarteners…and Christmas early. Thank you, Connecticut.”
He then posted, “The killer in CT was sent there by God to kill 18 children named Damien.”
Police said Bangayan was referencing the film, “The Omen.”
The 24-year-old was arrested Dec. 17 for criminal threats at his parents’ East Hollywood apartment.
Police found several weapons and ammunition at the residence, including a 12-gauge shotgun and a 9mm gun that were owned by the suspect’s father.
After Bangayan was taken into custody, LAPD Chief Charlie Beck said, “He was clear in his statements and his ability matched those statements. This was not a person who was unarmed. This was not a person that didn’t have a clear and present ability to make good on his threats.”
The District Attorney’s Office, however, said there was insufficient evidence to file a case and charges against Bangayan were dropped.
KCAL9’s Suraya Fadel said law enforcement sources told her the case continues to be investigated.

Kyle Bangayan Arrested For Making Political Statement About Newtown On Facebook?

Kyle Bangayan, the man accused of making Newtown-like threats to shoot up local schools, might have just been joking when me posted his feelings on Facebook.
In fact, he says he was making a political statement. That didn't stop the LAPD from going gangbusters on the East Hollywood home of his parents, though.
It has stopped the District Attorney's office from prosecuting the case, however:

The D.A.'s office yesterday said it wouldn't pursue the case, noting that the law in question, PC 422 (making criminal threats), requires specific targets.
Prosecutors' charge evaluation sheet says not only that the 24-year-old Cal Poly Pomona student failed to target specific individuals or locations, but that he told cops "he did this as a joke, and that he got some laughs from friends over it."
The FBI was part of the investigation but stated, according to the D.A.'s office, that it would have nothing to do with prosecution because agents found "nothing threatening."
Did cops overreact in the wake of the Newtown tragedy?
Authorities did find a cache of guns at the apartment of Bangayan's parents. But neighbors told KCAL9 yesterday that his dad is a gun collector.
The couple manages the building where Bangayan apparently lived before heading off to school in Pomona.

... state that if people don't stop about the shootings, he will do the same thing. He make [sic] references to the fact that thousands of kids die in third world countries every day and says Americans need to get over this incident.
